SUMMARY:

Dismissal of teachers. Defines for the purposes of the laws governing hiring, etc. of teachers and other personnel, "incompetency" as including, but not limited to, consistent failure to meet the endorsement requirements for the position or performance that is documented through evaluation to be consistently less than satisfactory. Under current law, teachers may be dismissed or placed on probation for incompetency, immorality, noncompliance with school laws and regulations, disability, certain felony convictions, and "other good and just cause." This bill also modifies disability as shown by competent medical evidence as grounds for dismissal of teachers to note that such dismissals are authorized only when in compliance with federal law. This bill interacts with the teacher grievance procedure. Dismissals covered by the teacher grievance procedure include dismissals occurring during the term of a teaching contract and the nonrenewal of the contract of a teacher who has earned continuing contract status.
