SUMMARY:

Public procurement; prequalification of contractors. Provides additional grounds for which prequalification of a contractor can be denied. The public body may use as grounds for denial any judgments against any officer, director or owner of the contractor, entered within the preceding 10 years. The bill requires written documentation that a contractor was in substantial noncompliance with another public body contract and that the contractor was given an opportunity to respond. Any crime involving contracting committed within the previous 10 years and debarment from bidding or contracting with any other public body or state or federal agency may also be grounds for denial.

The bill removes a cross-reference to the Freedom of Information Act relating to disclosure of trade secrets and replaces it with a correct cross-reference to the Public Procurement Act.
