AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to authorize the release of personal data by the Department of Motor Vehicles to toll facility operators and toll technology entities.

Be it enacted by the General Assembly of Virginia:

1. § 1. Notwithstanding any other provision of law, the Commissioner of the Department of Motor Vehicles may enter into agreements with private toll facility operators or toll collection technology entities to enable such operators or entities to obtain from the Department personal information, as described in § 46.2-208 of the Code of Virginia, in order to conduct motor vehicle research relating to methods of electronic toll collection. Any such agreement shall include provisions acceptable to the Commissioner designed to ensure that: (i) personal information shall not be further disclosed or otherwise disseminated by the operator or entity; (ii) the information furnished shall not be used for a purpose other than the purpose for which it was furnished, (iii) personal information shall be returned to the Department at the conclusion of the research; and (iv) the operator or vendor will not contact any individual identified by such personal information.

2. That the provisions of this act shall expire on July 1, 2005.
