SUMMARY AS PASSED:

Virginia Water and Waste Authorities; condemnation in certain counties. Provides that the governing body of Frederick County (described by population), when an authority proposes to exercise its power of eminent domain by condemning land on which a designated historic landmark, building, structure, district, object or site is located, may prohibit such exercise of power. The prohibition requires a two-thirds vote, and the vote must be taken within 90 days of the authority’s offer of purchase to the landowner. The act expires on July 1, 2004.

Provides that the governing body of a locality in which an authority proposes to exercise its power of eminent domain by condemning land on which a designated historic landmark, building, structure, district, object or site is located may prohibit such exercise of power. The prohibition requires a two-thirds vote, and the vote must be taken within 90 days of the authority’s offer of purchase to the landowner.

SUMMARY AS INTRODUCED:

Virginia Water and Waste Authorities Act. Provides that the governing body of a locality in which an authority proposes to exercise its power of eminent domain may petition the circuit court for a referendum in such locality on the question of such exercise of power.
