SUMMARY AS PASSED:
Public utilities; Utilities Facilities Act; exemption. Exempts from regulation under the Utilities Facilities Act, authorities created pursuant to the Virginia Water and Waste Authorities Act making a sale or ancillary transmission or delivery service of landfill gas to a commercial or industrial customer from a solid waste management facility permitted by the Department of Environmental Quality and operated by that same authority, if such an authority limits off-premises sale, transmission or delivery service of landfill gas to no more than one purchaser.

Public utilities; Utilities Facilities Act; exemption. Exempts from regulation under the Utilities Facilities Act, authorities created pursuant to the Virginia Water and Waste Authorities Act which sell landfill gas from a solid waste management facility permitted by the Department of Environmental Quality and operated by such an authority.
SUMMARY AS INTRODUCED:
Public utilities; exemption; Virginia Water and Waste Authorities Act. Exempts from regulation as public utilities, public service corporations or public service companies, authorities created pursuant to the Virginia Water and Waste Authorities Act which (i) sell landfill gas from a solid waste management facility permitted by the Department of Environmental Quality and operated by such an authority, or (ii) operate a pipeline or any related facilities incidental or necessary to the operation of the pipeline off premises in connection with such a sale, whether such gas is recovered, transported, transmitted, distributed or sold by such an authority or such person or persons.
