SUMMARY AS INTRODUCED:
Alcoholic beverage control; regulations of the ABC Board. Requires the ABC Board by regulation to establish reasonable requirements related to the issuance of banquet licenses to nonprofit corporations or associations in charge of special events where alcoholic beverages are sold to the public. Such requirements shall (i) require that food be available for purchase or consumption during all times that alcoholic beverages are being sold, (ii) limit the hours when alcoholic beverages may be sold and consumed, and (iii) limit the sale of an unlimited amount of alcoholic beverages for one price. In addition, the Board shall require that any banquet licensee subject to these regulations file, within 60 days after conclusion of the special event, a report of the income and expenses associated with the event on a form prescribed by the Board. Where profits are generated from the special event, the sponsoring nonprofit corporation or association shall also submit to the Board a certification that no part of the gross receipts derived from the event, including from the sale of alcoholic beverages, will be used for any purpose other than the reasonable and necessary operating costs directly related to the conduct of the event and the lawful and nonprofit purposes of the sponsoring nonprofit organization or association. In developing such requirements, the Board shall consider the size, nature, duration, and frequency of the special events conducted by the sponsoring nonprofit organization or association. The bill requires the ABC Board to adopt these final regulations on or before June 30, 2000. The bill also requires the ABC Board to study the feasibility and desirability of the application of “tied house” laws to banquet licensees who sell alcoholic beverages to the public, and requires the ABC Board to report its findings and recommendations to the House Committee on General Laws and the Senate Committee on Rehabilitation and Social Services on or before November 30, 1999.
