AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to provide for certain condemnation powers in certain counties.

Be it enacted by the General Assembly of Virginia:

1. Notwithstanding any contrary provisions of § 15.2-5114, upon a two-thirds vote of the governing body of any county with a population between 45,700 and 45,800 in which an authority created pursuant to Chapter 51 (§ 15.2-5100 et seq.) of Title 15.2 proposes to exercise its power of eminent domain by condemning land on which a designated historic landmark, building, structure, district, object or site is located, the governing body may prohibit the authority from exercising such power, provided that such vote occurs within ninety days of the authority's offer of purchase to the landowner.

2. That the provisions of this act shall expire on July 1, 2004.
