To the extent consistent with federal law, those facilities, originally permitted as sanitary landfills prior to March 15, 1993, and upon which solid waste has been disposed of prior to October 9, 1993, but which have been operating exclusively as a construction-demolition-debris landfill since December 21, 1988, or earlier, may continue to receive construction-demolition-debris waste until they have reached their vertical design capacity, provided that the facility is in compliance with the requirements for liners and leachate control in effect at the time of permit issuance, and further provided that the owner or operator of the solid waste management facility has complied with the applicable requirements of this subsection in effect through June 30, 1999.

That the provisions of this act shall not apply to any municipal solid waste landfill for which there exists a letter of agreement, entered into on or before October 30, 1998, between the owner of the landfill and the Department of Environmental Quality which provides for the progressive closure of the landfill in a manner protective of health, safety, welfare and the environment by a date later than June 30, 2003.
