SUMMARY:

Drug offenders; penalties. Requires every juvenile found to have committed a drug offense to undergo a substance abuse screening and assessment. Adults may voluntarily undergo such an assessment. The assessments must take place prior to sentencing or disposition.

The bill increases the penalty for persons convicted for a first distribution offense involving more than 100 grams of cocaine from the current penalty of five to 40 years, to five years to life.

The drug kingpin statute is moved to a new section, and modified to reduce the annual gross receipts requirement from $500,000 to $250,000 and the quantity of cocaine being distributed from 500 to 50 kilograms.

This bill is recommended by the joint subcommittee studying Virginia's drug laws.
