SB 1175 Referenda on sanitary landfills.

SUMMARY:

Referenda on sanitary landfills. Requires that a referendum be held in the locality where a sanitary landfill or a landfill expansion is proposed if the landfill or the expanded landfill will have a 1,500 ton per day or more capacity. A permit for the landfill or an expansion of an existing landfill may not be issued by the Waste Management Board unless such a referendum has been held. However, the bill does not require voter approval for a permit. One question is authorized to be on the ballot, and it asks whether or not citizens of the locality agree that the permit should be issued. Statements may be added to the ballot regarding monetary benefits to the locality and post closure responsibility of the owner or operator as represented by the permit applicant of the proposed landfill. The court authorizing the ballot must find that the local government has provided sufficient supporting evidence of the statements before they may be placed on the ballot.
