SUMMARY:
Assault and battery against a law-enforcement officer. Provides that a person who commits a simple assault or assault and battery against a law-enforcement officer shall be guilty of a Class 1 misdemeanor and sentenced to a mandatory, minimum term of confinement for six months, 30 days of which cannot be suspended. The bill also increases the penalty to a Class 6 felony from a Class 1 misdemeanor, but keeps the minimum, mandatory period of incarceration at six months for assault and battery using a firearm against a law-enforcement officer.
