SUMMARY:
Administrative Process Act; issues on review. Provides that the court may, if it finds that a manifest injustice will occur, (i) remand the case to the agency with instructions or (ii) try an APA appeal de novo in any case in which the hearing officer deciding or recommending a decision in the case is employed by an agency which (i) is a party to an enforcement preceding and (ii) is exempt from the requirement to use a hearing officer from the list maintained by the Executive Secretary of the Supreme Court.
