977802685Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 4 of Chapter 3.1 of Title 62.1 a section numbered 62.1-44.19:4 as follows:
§ 62.1-44.19:4. Interbasin transfer of sewage.
A. The Board shall not issue, nor grant the modification of, a permit
allowing any discharge into [ state
waters the Rappahannock River ] if the discharge
contains components of sewage from a subbasin outside the receiving basin
unless the discharge meets the same standards as would be applicable in the
source subbasin if discharged there and there has been held, by the permit
applicant, at least one public hearing in the receiving basin in the area of
the proposed discharge. Any public hearing held pursuant to the requirements
of this section shall be preceded by public notice in a newspaper of general
circulation in the locality where the discharge is proposed to take place. The
notice shall give the date, time and location of the hearing, and
specifications regarding the proposal including the amount of sewage proposed
to be coming from the source basin and all alternatives to the proposal
considered by the applicant. The notice shall be published in each of the six
weeks preceding the hearing.
B. The provisions of this section shall not be construed as requiring or
allowing the Board to lower any discharge, water quality or treatment standard
in a receiving basin. [ The provisions of this section shall not
apply to any sewage treatment plant permitted prior to July 1, 1997. ]
