AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding sections numbered 22.1-279.4 and 63.1-198.05, relating to participation in certain school and day-care activities by noncustodial parents.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding sections numbered 22.1-279.4 and 63.1-198.05 as follows:

§ 22.1-279.4. Participation in certain school activities by noncustodial parent.

Unless a court order has been issued to the contrary, the noncustodial parent of a student enrolled in a public school shall not be denied the opportunity to participate in any of the student's school activities in which such participation is supported or encouraged by the policies of the school solely on the basis of such noncustodial status. For the purposes of this section, "school activities" include, but are not limited to, lunch breaks, special in-school programs, parent-teacher conferences and meetings, and extracurricular activities. It shall be the responsibility of the custodial parent to provide the court order to the school.

§ 63.1-198.05. Participation in certain day-care activities by noncustodial parent.

Unless a court order has been issued to the contrary, the noncustodial parent of a child enrolled in a day-care center shall not be denied the opportunity to participate in any of the child's day-care activities in which such participation is supported or encouraged by the policies of the day-care center solely on the basis of such noncustodial status. For the purposes of this section, "day-care activities" include, but are not limited to, lunch breaks, in-center programs, parent-teacher conferences and meetings, and other special activities. It shall be the responsibility of the custodial parent to provide the court order to the day care center.
