Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 11-78.1 as follows:

§ 11-78.1. Participation in bid preparation; limitation on submitting bid for same procurement.

No person who assists a public body with or participates in the preparation of an invitation to bid or request for proposal shall (i) submit a bid or proposal for that procurement or any portion thereof or (ii) disclose to any bidder or offeror information concerning the procurement which is not available to the public.

2. That the provisions of this act shall not affect the validity of any procurement contract entered into prior to July 1, 1997.
