1997 SESSION
962040254Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-51.4 as follows:
§ 18.2-51.4. Maiming, etc., of another
resulting from driving while intoxicated.
Any person who, as a result of driving while intoxicated in violation of clause (ii), (iii) or (iv) of § 18.2-266, causes the severe injury of another person resulting in permanent and significant physical impairment shall be guilty of a Class 6 felony.
2. That the provisions of this act may result in a net increase in periods of imprisonment in state correctional facilities. Pursuant to § 30-19.1:4, the estimated amount of the necessary appropriation is $375,000.
