SUMMARY:
Banking and finance; Wet Settlement Act; settlement agents. Requires real estate transaction settlement agents to act in accordance with the highest standards of fiduciary conduct. The bill requires them to ensure their compliance with all applicable laws and regulations. The bill also directs the Department of Professional and Occupational Regulation to promulgate regulation to establish settlement agent registration and financial responsibility requirements which may include the payment of annual registration fees. The Board of Professional and Occupational Regulation is directed to conduct a study to determine the appropriate level of regulation for settlement agents. The Board will report its findings to the Governor and the 1997 Session of the General Assembly. The bill exempts from its registration and financial responsibility requirements, attorneys-at-law, title insurance companies and agents and parties to real estate transactions (including lenders). Its provisions will become effective on July 1, 1997.
