SUMMARY:

Performance-based regulation of gas utilities. Authorizes the State Corporation Commission to approve an application from a gas utility to implement a form of rate regulation proposed by the gas utility (replacing the form of regulation required under § 56-235.2) if the SCC finds that the performance-based ratemaking methodology (i) preserves adequate service, (ii) does not unreasonably prejudice or disadvantage any class of customers, (iii) provides incentives for improved performance, (iv) results in rates that are not excessive and (v) is in the public interest.
