SUMMARY:
Local authority to regulate agricultural land use. Changes certain standards in the Right to Farm Act. Currently, local authority to require a special exception or special use permit for above ground application or storage of sewage sludge is not restricted by the Act. The bill limits local authority to regulate (i) sewage sludge application of Class 1 biosolids meeting regulatory requirements for distribution and marketing and (ii) application of any type of sewage sludge once every three years or less frequent application. The bill also limits localities' authority to enact zoning ordinances which would restrict or regulate farm structures or farming and forestry practices. It is specified that state standards regarding minimum area and setback requirements would govern where they have been established.
