HB 1231 Tobacco product vending machines.

SUMMARY:

Tobacco product; sales to minors; vending machines. Enhances the penalty which may be imposed upon a minor found to have committed a third violation of the prohibition on the purchase of tobacco products to allow the court to suspend the minor's driver's license or to impose a curfew on his driving privileges.

The bill also prohibits the sale of tobacco products from a vending machine unless the machine is located in a place not open to the general public and not normally accessible to minors. If a vending machine is in a place open to the general public, it must be inside the establishment and within the normal line of sight of the proprietor or an employee unless it is more than 10 feet from the entrance or requires a token for operation. Prohibited vending machine sales are made punishable by a civil penalty of up to $100, enforceable by the local city, county or town attorney and payable into the local treasury.

The Department of Agriculture and Consumer Services is authorized to promulgate regulations to ensure compliance with federal requirements for state action to reduce the incidence of teen smoking.
