SUMMARY:

Public-Private Transportation Act of 1995. Rewrites the Qualifying Transportation Facilities Act of 1994 which was passed during the 1994 Session with a delayed effective date of 7/1/95. The Act as passed in 1994 would permit privatization of transportation facilities and grant the State Corporation Commission certificate of authority and rate approval functions. The most significant change made by this bill is to eliminate the regulatory role of the SCC. Other changes include (i) expanding the definition of transportation facilities to include parking and port facilities, (ii) deleting the provision that no tolls or user fees may be imposed by an operator on an existing road without consent of the affected locality and (iii) clarifying that the provisions of the Virginia Public Procurement Act do not apply to the Transportation Act. This bill is a recommendation of the Joint Subcommittee Studying the Privatization of Certain State Government Functions (SJR 17, 1994).
