SUMMARY:
Conflict of interests; school board employees. Codifies previous opinions of the Attorney General by allowing school boards to employ a relative of a school board member or division superintendent who was employed by the school board at any time prior to June 10, 1994, and prior to the relative taking office. Relatives employed on and after June 10, 1994, would not be covered by this exception to the State and Local Government Conflict of Interests Act. This measure seeks to address the Virginia Supreme Court case of Williams v. Augusta County School Board, in which the Court found that the plaintiff, who had been employed prior to, but not at the time of, her relative's taking office, was ineligible for re-employment. The Court's opinion was rendered June 10, 1994; this bill would “grandfather” in those employees hired in good faith prior to the Court's decision. An emergency clause makes the bill effective upon final passage.
