SUMMARY:
Notification of teacher employment. Changes the notification date for employment of probationary teachers from April 15 to July 15; the April 15 notification date for continuing contract teachers remains unchanged. In addition, any teacher may resign after July 15 with local school board approval. School boards would be required to notify continuing contract teachers of their salaries as soon after April 15 as possible, following approval of the school board budget by the local governing body; probationary teachers would be notified on or before July 15.
Under current law, it is the duty of the school board to supply written notice of nonrenewal of a probationary contract by April 15. The teacher must accept or reject, in writing, a reemployment offer within 15 days of receipt of notice. Failure by the school board to supply this notice by April 15 entitles the probationary teacher to a contract for the following year. Currently, written notice of noncontinuation by a continuing contract teacher or by the school board must be provided by April 15; otherwise, the contract automatically continues for an additional year, consistent with local salary stipulations.
The April 15 date designated for contract renewal notices is tied to local budget development and approvals. The school board's annual budget estimate must be submitted to the governing body on or before April 1 of each year. Factored into this budget is the estimate of the Superintendent of Public Instruction of the proposed state basic aid to each locality, which must have been transmitted to the school divisions and local governing bodies within 15 days of the adjournment of the legislative session. Approval of the education budget by the local governing body must occur by May 1 (or within 30 days of the receipt of the estimated state moneys, whichever occurs later) in the case of counties and by May 15 (or within 30 days of the receipt of the estimated state moneys, whichever occurs later) in the case of municipalities.
