SUMMARY:
Frivolous claims sanctions. Allows the court to impose sanctions where a pleading, motion or other paper is frivolously advocated. Under current law, it is not clear that sanctions could be imposed in a situation where the pleading, for example, is valid when filed but advocated after it is discovered to be frivolous.
The bill also allows the court to entertain a motion for sanctions filed within 21 days of final judgment.
The bill is recommended by the Boyd-Graves Conference.
