SUMMARY:

In-state tuition for certain students. Entitles a dependent student, who when entering an institution of higher education was classified as an in-state student and whose parent or legal guardian has subsequently abandoned his Virginia domicile, to in-state tuition for the remainder of the year following such abandonment and also for the following academic year. In addition, a dependent student initially classified as in-state and whose parents move out of Virginia may demonstrate domiciliary intent by his presence or residence in Virginia. Under current law, the domicile of a dependent student is deemed to be that of the parent or guardian. The student is entitled to in-state tuition if the parent had established Virginia domicile, as demonstrated by factors such as residence, property ownership, or tax payments, for the previous year. This measure seeks to address those situations when the parent's Virginia domicile is abandoned mid-year; status as an in-state student would not change during the ensuing academic year.
