HB 1354 Expanded discovery in medical malpractice actions.
Introduced by: W. Roscoe Reynolds | all patrons ... notes | add to my profiles
SUMMARY:
Expanded discovery in medical malpractice actions. Allows a court to enter an order for good cause shown that counsel for all parties in the matter and all health care providers who have treated the plaintiff confer and discuss the facts and opinions regarding the plaintiff's treatment. The bill also allows counsel to agree on what can be disclosed without court order. The bill also removes "clinical psychologist" from the definition of health care practitioner, for the purposes of this law. Current law allows discovery of such facts and opinions only through discovery and trial subject to privilege of physician/patient communications.
