SUMMARY:
Protection of water sources from gas and oil drilling operations. Establishes a rebuttable presumption that any contamination or deprivation of a water supply occurring within 1,500 feet of a gas or oil well, and within six months after the drilling of the well, was proximately caused by the drilling operations. The presumption can be rebutted by showing that the pollution existed prior to the drilling as determined by a pre-drilling survey, the water supply is not within 1,500 feet of the well, the pollution occurred more than six months after the completion of the drilling, or the pollution occurred as the result of some other cause. The bill establishes a procedure for the well operator to sample and analyze water near the well prior to drilling. Certified results of the water testing are to be provided to the Gas and Oil Inspector and to owners and occupants of the land in the proximity of the well who have requested the results.
