Whenever the magistrate knows that the person whose mental health is in question is the patient of a licensed psychiatrist, psychologist or physician skilled in the diagnosis and treatment of mental illness, the magistrate shall order that an evaluation be performed, when feasible, by such psychiatrist, psychologist or physician rather than by a person designated by the community services board.

For the purposes of this section, whenever the magistrate knows that the person whose mental health is in question is the patient of a licensed psychiatrist, psychologist or physician skilled in the diagnosis and treatment of mental illness, the magistrate may (i) dispense with any evaluation by the local community services board or its designee, and (ii) rely upon the advice and evaluation of such psychiatrist, psychologist or physician skilled in the diagnosis and treatment of mental illness in lieu of any advice and evaluation of the local community services board employee or designee. If the magistrate dispenses with an evaluation by the community services board or its designee, he may nonetheless consider its recommendation regarding the facility for temporary detention; however, the magistrate shall also consider the recommendation of the subject person's psychiatrist, psychologist or physician skilled in the diagnosis and treatment of mental illness.
