SUMMARY:

Right to farm. Prohibits counties, cities or town from requiring that a special exception or special use permit be obtained for any production agriculture or silviculture activity in an area that has been zoned as an agricultural district. However, localities may adopt setback, minimum area, and other requirements for lands on which agricultural activity is occurring. Localities would be prohibited from enacting zoning ordinances which unreasonably restrict or regulate farm structures or farming and forestry practices in agricultural districts or classifications, unless such restrictions are related to the public's health, safety and general welfare. These previous provisions will become effective April 1, 1995. The bill also establishes that no agricultural operation can be considered a nuisance if it follows best management practices and complies with existing laws and regulations. This provision will become effective July 1, 1994.
