SUMMARY:
Driving under the influence. Eliminates the distinction, for penalty purposes, between second offenses occurring within five years of a first offense and those occurring within five to ten years of a first offense. Any second offense occurring within ten years of a first offense will be punished by a fine of $200 to $2,500 and one month to one year in jail, subject to a mandatory minimum jail term of 48 hours. This is the same penalty as was previously authorized for second offenses occurring within five years of a first offense. The penalty for a third offense or subsequent offense committed within 10 years of a first offense is increased to a Class 6 felony.
