HB 1318 Repeat violent offenders.

SUMMARY:

Repeat violent offenders. Creates an enhanced penalty provision for repeat violent felony offenders. For offenses with a minimum sentence of 10 years or less, the punishment is increased to 20 years to life, if the offense is a second violent felony. For offenses with a minimum sentence of more than 10 years, the punishment is increased to 40 years to life if the offense is a second violent felony. Persons found guilty of a Class 1 felony (capital murder) are not subject to these provisions. If a case subject to these penalties is tried by a jury, the proceeding is to be bifurcated.

This is an administration bill.

The bill is to become effective only if an appropriation is made in the 1994 budget bill to cover the estimated $19.6 million fiscal impact on the corrections system.
