Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 15.2-2223.6 as follows:
§ 15.2-2223.6. Comprehensive plan shall address limiting vape shops near schools.
During an amendment of a locality's comprehensive plan after July 1, 2024, the locality shall incorporate into its comprehensive plan strategies to limit vape shops near schools for the purpose of reducing use of nicotine vapor products by youth. Such strategies may include (i) restricting the location of vape shops in the proximity of a school, using any standard footage that is used as a protective zone around schools; (ii) the creation of licensing and permit requirements for vape shops; and (iii) restricting the hours of operation of such vape shops near schools.
