24102734DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 38.2-3407.15:8 as follows:
§ 38.2-3407.15:8. Cost-sharing requirements for the treatment of cancer; prohibited for individuals 18 years of age or younger.
A. As used in this section:
"Cost sharing" means any coinsurance, copayment, or deductible.
"Enrollee" means any person entitled to health care services from a carrier.
B. No (i) insurer proposing to issue individual or group accident and sickness insurance policies providing hospital, medical and surgical, or major medical coverage on an expense-incurred basis, (ii) corporation providing individual or group accident and sickness subscription contracts, and (iii) health maintenance organization providing a health care plan for health care services shall impose (a) any cost-sharing requirement for the treatment of cancer and (b) if the policy, contract, or plan, including any certificate or evidence of coverage issued in connection with such policy, contract, or plan, includes coverage for medicines, any cost-sharing requirement for a covered prescription drug for the treatment of cancer in an enrollee who is 18 years of age or younger under such policy, contract, or plan delivered, issued for delivery, or renewed in the Commonwealth.
C. The provisions of this section shall not apply to short-term travel, accident-only, limited or specified disease policies, or contracts designed for issuance to persons eligible for coverage under Title XVIII of the Social Security Act, known as Medicare, or any other similar coverage under state or federal governmental plans or to short-term nonrenewable policies of not more than six months' duration.
D. This section shall apply with respect to policies, contracts, or plans entered into, amended, extended, or renewed on or after January 1, 2025.
