Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 22.1-289.05:1 as follows:

§ 22.1-289.05:1. Child Care Implementation and Substitute Employee Pool Grant Program.

A. With such funds as may be appropriated for such purpose pursuant to the general appropriation act, the Department shall establish and administer the Child Care Implementation and Substitute Employee Pool Grant Program (the Program) whereby any (i) existing child day program provider or group of such providers may apply for a grant, on a competitive basis, for the establishment of a substitute employee pool that, notwithstanding the provisions of subsection E of § 22.1-289.035, enables such provider or providers to ensure efficient and effective staffing with qualified employees or (ii) prospective child day program may apply for a grant, on a competitive basis, to cover costs associated with implementing such program.

B. The Department shall establish such rules, regulations, processes, procedures, and deadlines as it deems necessary for the proper administration of the Program.
