Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 36-99.7:1 as follows:

§ 36-99.7:1. Mold inspections.

A local building department shall not issue a building permit until the local building department receives certification from the owner or his agent that the building has been inspected for the presence of black mold and that no black mold was found or that appropriate remediation will be undertaken in accordance with the requirements of the Uniform Statewide Building Code (§ 36-97 et seq.).

2. That the Board of Housing and Community Development (the Board) shall promulgate regulations to implement the provisions of this act to be effective within 280 days of its enactment. Such regulations shall become part of the Uniform Statewide Building Code (§ 36-97 et seq. of the Code of Virginia) and shall address mold accumulation, prevention, and remediation. Such regulations shall include a requirement that any dwelling unit in which a local building department has verified the existence of black mold shall be deemed to be in violation of the Uniform Statewide Building Code if remediation of such mold is not made within a reasonable timeframe, such timeframe to be established by the Board.

3. That the provisions of the first enactment of this act shall become effective on the date on which the regulations promulgated by the Board of Housing and Community Development (the Board) pursuant to the second enactment of this act become effective. The Board shall certify in writing to the Code Commission the date upon which such regulations become effective.
