Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 22.1-1.1 as follows:

§ 22.1-1.1. Parents' bill of rights.

Consistent with § 1-240.1, the parents of each public elementary or secondary school student in the Commonwealth have the right to:

1. Review any books, curricula, or instructional materials being taught or made available to their child;

2. Opt their child out of any sexually explicit instructional material or assignments as set forth in § 22.1-16.8;

3. Know who is instructing their child, including any outside presenters or lecturers;

4. Visit their child's school during school hours to meet with, or to schedule a meeting with, a school representative;

5. Review all records created or held by the school about their child;

6. Receive information regarding the collection and transmission of their child's data and opt out of any data collection without penalty to their child;

7. Be notified of, review ahead of time, and opt their child out of any surveys offered to them by any school representative;

8. Be notified of any situation that directly affects their child's safety at school;                                                                                                         

9. Be made aware of any counseling services that their child is receiving while at school; and

10. Make all medical decisions for their child.
