Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 14 of Title 10.1 an article numbered 3.8, consisting of a section numbered 10.1-1425.40, as follows:

Article 3.8.
Recycling Infrastructure Improvement Fund.

§ 10.1-1425.40. Recycling Infrastructure Improvement Fund.

A. There is hereby created in the state treasury a special nonreverting fund to be known as the Recycling Infrastructure Improvement Fund. The Fund shall be established on the books of the Comptroller. Notwithstanding any other provision of law, the Fund shall be administered as a grant program within the Department of Environmental Quality for the purpose of supporting local government recycling programs.

B. All funds appropriated for such purpose, any gifts, donations, grants, bequests, and other funds received on its behalf, and funds disbursed pursuant to § 58.1-1710 shall be paid into the state treasury and credited to the Fund. Interest earned on moneys in the Fund shall remain in the Fund and be credited to it. Any moneys remaining in the Fund, including interest thereon, at the end of each fiscal year shall not revert to the general fund but shall remain in the Fund. Moneys in the Fund shall be used solely for the purposes of this article. Expenditures and disbursements from the Fund shall be made by the State Treasurer on warrants issued by the Comptroller upon written request signed by the Secretary.

C. The Department shall promulgate regulations to establish grant eligibility and other program requirements. Such regulations shall encourage the establishment of physical infrastructure and equipment necessary to start or improve local government recycling operations. Grant funds awarded to local governing bodies shall be used to purchase physical infrastructure and equipment necessary to start, improve processing efficiencies for, or lower operating or environmental compliance costs for local government recycling operations. Local governments are authorized and encouraged to use the funds in public-private partnerships for the same purposes.

D. The Department shall report annually by October 1 to the Governor and the Chairs of the House Committee on Agriculture, Chesapeake and Natural Resources and the Senate Committee on Agriculture, Conservation and Natural Resources the status of the Fund, including an explanation as to the structure and results of the grant program.

2. That all local governments shall be restricted from discontinuing their recycling programs until after July 1, 2028.
