SUMMARY AS PASSED SENATE: (all summaries)

Virginia Freedom of Information Act; exclusions; proprietary records and trade secrets; Fort Monroe Authority. Excludes from mandatory disclosure under the Virginia Freedom of Information Act trade secrets, proprietary information, or financial information supplied by an individual or a private or nongovernmental entity to the Fort Monroe Authority for the purpose of complying with the obligations of any lease, easement, license, permit, or other agreement, whether of a commercial or residential real estate nature, pertaining to the use or occupancy of any portion of Fort Monroe. The bill provides that in order for such trade secrets, proprietary information, or financial information to be excluded, the applicant shall (i) invoke this exclusion upon submission of the data or other materials for which protection from disclosure is sought, (ii) identify with specificity the data or other materials for which protection is sought, and (iii) state the reasons why protection is necessary. This bill is identical to HB 2394.
