SUMMARY AS PASSED:

Virginia Employment Commission; attorney authorization; powers. Provides that the Commissioner of the Virginia Employment Commission may authorize any attorney employed by the Commission to issue subpoenas to compel the attendance of witnesses and the production of books, papers, correspondence, memoranda, and other records deemed necessary as evidence in connection with the investigation or adjudication of any disputed claim or the administration of the Virginia Unemployment Compensation Act. The bill permits any party to file a motion to quash any such subpoena prior to the date production is required in a miscellaneous action in circuit court. This bill is identical to HB 2010.

Provides that an attorney for the Commissioner of the Virginia Employment Commission is authorized to issue subpoenas to compel the attendance of witnesses and the production of books, papers, correspondence, memoranda, and other records deemed necessary as evidence in connection with the investigation or adjudication of any disputed claim or the administration of the Virginia Unemployment Compensation Act. The bill permits any party to file a motion to quash any such subpoena prior to the date production is required in a miscellaneous action in circuit court.

Virginia Employment Commission; authorized representative or member of Commission; powers. Provides that the Commissioner of the Virginia Employment Commission has the authority to authorize any representative or member of the Commission to have the power to administer oaths and affirmations, take depositions, certify to official acts, and issue subpoenas to compel the attendance of witnesses and the production of books, papers, correspondence, memoranda, and other records deemed necessary as evidence in connection with the investigation or adjudication of any disputed claim or the administration of the Virginia Unemployment Compensation Act.
