AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to exempt certain nursing home services in Amherst County from the requirements of a certificate of public need.

Be it enacted by the General Assembly of Virginia:

1. § 1. Notwithstanding Article 1.1 (§ 32.1-102.1 et seq.) of Chapter 4 of Title 32 of the Code of Virginia and any applicable regulations, the State Health Commissioner shall accept and review applications and shall issue a certificate of public need for a new 90-bed nursing home facility, given the unique and extenuating circumstances of this potential facility, provided that such facility is located on the property of the former Central Virginia Training Center in Amherst County and is owned by the Commonwealth as of July 1, 2023. Such beds may be transferred by the Commonwealth upon sale of the property.
