Be it enacted by the General Assembly of Virginia:

1. That § 28.2-104 of the Code of Virginia is amended and reenacted as follows:

§ 28.2-104. Commissioner; general powers and duties.

A. As used in this section:

"Civic organization" means any local service club, veterans post, fraternal society or association, or local civic league or association of 10 or more persons not organized for profit but operated exclusively for educational or charitable purposes, including the promotion of community welfare, and the net earnings of which are devoted exclusively to charitable, educational, recreational, or social welfare purposes.

"Virginia Peninsula" means the Cities of Hampton, Newport News, Poquoson, and Williamsburg and James City and York Counties.

B. The Commissioner shall:

1. Enforce the marine fishery and habitat laws and regulations;

2. Serve as chief executive officer of the Commission and devote full time to the duties of the office;

3. Appoint all personnel; and

4. Establish and equip a permanent office on the Virginia Peninsula; and

5. Ensure that public notice is provided electronically to any business, residence, or civic organization, upon request to be added to the Commission's public notice email list, for any floating aquaculture or oyster broodstock reef project under consideration for a permit issued by the Commission.

For purposes of this section, "Virginia Peninsula" shall include the Cities of Hampton, Newport News, Williamsburg, and Poquoson, and the Counties of James City and York.
