AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to direct the Department of Education to develop and promulgate regulations to enforce a code of ethics for Individualized Education Program (IEP) meetings relating to appropriate participation and collaboration.

Be it enacted by the General Assembly of Virginia:

1. § 1. That the Department of Education (the Department) shall convene a work group to provide recommendations for the development of a code of ethics relating to effective collaboration at Individualized Education Program (IEP) meetings among school staff, parents, students, and any other participants with expertise or knowledge of the student. The work group shall submit its recommendations to the Department by November 30, 2023. The work group shall include:

1. A facilitator with knowledge and expertise in the scope and mission of the IEP;

2. The director of the disAbility Law Center or his designee;

3. Representatives from (i) the Legal Aid Justice Center, (ii) the Parent Educational Advocacy Training Center (PEATC), (iii) the Council of Parent Attorneys and Advocates (COPPA), (iv) the Virginia School Counselor Association, (v) the Arc of Virginia or the Virginia Down Syndrome Association, (vi) ChildSavers or Communities in Schools of Virginia, (vii) community services boards, and (viii) the Department;

4. Three representatives from the Virginia Council of Administrators of Special Education;

5. Four parents, guardians, or caregivers of children with IEPs, with attention to families of color, families for whom English is not the primary language, and families who are economically disadvantaged;

6. An independent parent advocate; and

7. One division superintendent.
