Be it enacted by the General Assembly of Virginia:

1. § 1. That the Board of Education (the Board) shall develop a code of ethics relating to appropriate collaboration at Individualized Education Program (IEP) meetings among school staff, parents, students, and any other participants invited with expertise or knowledge of the student, to be referred to as the Code of Ethics for Special Education Meeting Participants (the Code of Ethics). The Code of Ethics shall be consistent with the Council of Parent Attorneys and Advocates Voluntary Code of Ethics and the Superintendent of Public Instruction's Memo # 263–16 (October 18, 2016): Collaboration among Parents, Parent Advocates, and Professionals in IEP Meetings and shall include information specifying disruptive conduct in the meeting process and remedies for maintaining an orderly meeting process. The regulations governing individualized education programs in 8VAC20-81-110 shall require the local educational agency to (i) make available a written copy of the Code of Ethics, as developed and approved by the Board pursuant to this act, at each IEP meeting; (ii) ensure that the Code of Ethics applies to all participants in each IEP meeting held under the federal Individuals with Disabilities Education Act, 20 U.S.C. § 1400 et seq.; and (iii) ensure that the Code of Ethics is enforced by the local educational agency in any local meeting, by appointed mediators in any mediation meeting, and by due process hearing officers in any meeting that is part of a due process hearing where an IEP is being considered. The Board shall amend such regulations as may be necessary to effectuate the provisions of this act.
