AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend the Code of Virginia by adding a section numbered 54.1-3420.3, relating to prescriptions; telemedicine; refusal to fill prescription from telemedicine provider; prohibition.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 54.1-3420.3 as follows:

§ 54.1-3420.3. Prohibition on refusing to fill prescription from telemedicine provider.

A. A pharmacist shall not implement or adhere to a policy that prevents the pharmacist from dispensing a prescription solely on the basis of the prescriber's use of a telemedicine platform to provide services.

B. A pharmacist shall not prioritize dispensing a prescription from a prescriber who does not use telemedicine over dispensing a prescription from a prescriber who does use telemedicine solely on the basis of the prescriber's use of a telemedicine platform to provide services.
