Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 1 of Title 32.1 an article numbered 6, consisting of a section numbered 32.1-34.4, as follows:
§ 32.1-34.4. Automated external defibrillator required in sports facilities.
A. As used in this section:
"Automated external defibrillator" means a device that combines a heart monitor and defibrillator and (i) has been approved by the U.S. Food and Drug Administration; (ii) is capable of recognizing the presence or absence of ventricular fibrillation or rapid ventricular tachycardia; (iii) is capable of determining, without intervention by an operator, whether defibrillation should be performed; and (iv) automatically charges and requests delivery of an electrical impulse to an individual's heart upon determining that defibrillation should be performed.
"Sports facility" means (i) a stadium or arena for sports team competitions; (ii) practice facilities or other areas where sports teams may practice or perform; (iii) offices for sports teams or franchises; (iv) office, restaurant, concessions, retail, and lodging facilities that are owned and operated in connection with a sports stadium or arena or other structure; or (v) any other directly related properties, including onsite and offsite parking lots, garages, and other properties.
B. Every sports facility in the Commonwealth shall have a working automated external defibrillator.
