23103762DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 46.2-838.1 as follows:
§ 46.2-838.1. Passing certain stopped vehicles; motorcycles.
A. Notwithstanding the provisions of § 46.2-857, an operator of a two-wheeled motorcycle may overtake and pass another vehicle that is stopped in the same direction of travel and in the same lane as the operator and may operate the motorcycle between lanes of traffic when:
1. The operator is on a divided highway with at least two lanes of travel in each direction that has a speed limit that does not exceed 45 miles per hour;
2. The operator travels at a speed that does not exceed 15 miles per hour; and
3. The operator may pass the other vehicle safely.
B. Nothing in this section shall (i) prohibit passing otherwise authorized pursuant to this chapter or (ii) authorize the passing of a stopped school bus as prohibited in §§ 46.2-844 and 46.2-859.
