Be it enacted by the General Assembly of Virginia:

1. That § 37.2-308 of the Code of Virginia is amended and reenacted as follows:

§ 37.2-308. Data reporting on children and adolescents.

A. The Department shall collect and compile the following data:

1. The total number of licensed and staffed inpatient acute care psychiatric beds for children under the age of 14 and adolescents ages 14 through 17; and

2. The total number of licensed and staffed residential treatment beds for children under the age of 14 and adolescents ages 14 through 17 in residential facilities licensed pursuant to this title, excluding group homes.

B. The Department shall collect and compile data obtained from the community policy and management team pursuant to subdivision 16 of § 2.2-5206 and each community services board or behavioral health authority pursuant to § 37.2-507 and subdivision 17 of § 37.2-605. The Department shall ensure that the data reported is not duplicative.

C. The Department shall report this data on a quarterly basis to the Chairmen of the House Committee on Appropriations and the Senate Committee on Finance and Appropriations and to the Virginia Commission on Youth.

2. That the Department of Behavioral Health and Developmental Services shall modify the reporting requirements required under 12VAC35-105-160 of the Virginia Administrative Code for Level II and Level III serious incidents. The reporting requirements shall read "Level II and Level III serious incidents shall be reported using the department's web-based reporting application and by telephone or email to anyone designated by the individual to receive such notice and to the individual's authorized representative within 24 hours of discovery, or the next business day if the incident occurs on a weekend or holiday."

3. That the Department of Behavioral Health and Developmental Services shall allow providers access to reports made by a provider through the Department's web-based reporting application, pursuant to 12VAC35-105-160 of the Virginia Administrative Code to ensure that serious incident reports are not duplicated.
