23102621DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 4.1-604.1 as follows:
§ 4.1-604.1. Limitations on certain powers of the Board.
A. The Board shall not grant, suspend, or revoke licenses for the cultivation, manufacture, distribution, sale, or testing of marijuana and marijuana products in a manner that allows for the creation of a monopoly or otherwise lessens competition in the marijuana industry in the Commonwealth. All citizens of the Commonwealth shall have equal access to apply for any such license, and the Board shall not unfairly restrict or hinder the entry of any such citizen into the marijuana industry in the Commonwealth.
B. No fee for licensure set by the Board pursuant to this subtitle shall exceed $1,000.
