AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend and reenact § 30-19.1:9 of the Code of Virginia, relating to bills creating certain boards and commissions; required sunset provision.

Be it enacted by the General Assembly of Virginia:

1. That § 30-19.1:9 of the Code of Virginia is amended and reenacted as follows:

§ 30-19.1:9. Duration of boards and commissions.

A. After January 1, 2003, all bills creating an advisory board, council, commission or other collegial body in the executive branch of state government shall contain a provision requiring the expiration of such body three years after its creation.

B. After January 1, 2024, all bills creating a board, council, commission, or other collegial body in the legislative branch of state government shall contain a provision requiring the expiration of such body three years after its creation.

2. That no later than October 1, 2023, the Clerks of the House of Delegates and the Senate of Virginia shall submit to the Virginia Code Commission a list of all boards, councils, commissions, and other collegial bodies in the legislative branch, and the Secretary of the Commonwealth shall submit to the Virginia Code Commission a list of all advisory boards, councils, commissions, and other collegial bodies in the executive branch, that are not set to expire within three years of the effective date of this act. The Virginia Code Commission shall submit to the General Assembly for its consideration and approval at the 2024 Regular Session a bill prescribing for each such board, council, commission, or other collegial body an expiration date that is no later than July 1, 2027.
