2023 SESSION
23103761DBe it enacted by the General Assembly of Virginia:
1. That § 46.2-610 of the Code of Virginia is amended and reenacted as follows:
§ 46.2-610. Suspension of registration on theft or embezzlement of vehicle; notices.
A. Whenever the owner of any
motor vehicle, trailer, or semitrailer which that is stolen or embezzled
notifies the Department directly or through law-enforcement authorities of the
theft or embezzlement, the Department shall immediately suspend the
registration of that motor vehicle, trailer, or semitrailer until such time as
it shall be notified that the owner has recovered his motor vehicle, trailer,
or semitrailer. In the event of an embezzlement,
the owner shall obtain a warrant for the arrest of the person charged with the
embezzlement before the Department shall suspend the registration. Any such suspension
shall be effective only for the current registration period in which the notice
was given. If during that period the motor vehicle, trailer, or semitrailer is
not recovered, a new notice may be given with like effect during the ensuing
period. Every owner who has given a notice of theft or embezzlement shall
immediately notify the Department of the recovery of his motor vehicle,
trailer, or semitrailer.
B. The Department shall notify the Department of Transportation or other operator of any toll bridge, toll road, or other toll facility obtaining information from the Department for the enforcement of a toll violation if the motor vehicle, trailer, or semitrailer involved in such violation had its registration suspended pursuant to this section at the time of the violation using the words "stolen or embezzled." Upon notification that the registration of such motor vehicle, trailer, or semitrailer was suspended pursuant to this section at the time of the violation, the toll operator shall not issue a citation for an unpaid toll to the owner of such vehicle.
